## 1.About us and the service

Analytics by 5H3LL (“**5H3LL**”, “we”, “us”) provides a web analytics service at analytics.5h3ll.site, including the tracking script, the dashboard, the live view, optional revenue attribution, team sharing, support tickets and agent access (together, the “**Service**”). You can contact us at [support@5h3ll.site](mailto:support@5h3ll.site).

The Service is designed for businesses and independent professionals. “You” means the person or company that holds the account. These terms apply to customers throughout the United Kingdom: England, Wales, Scotland and Northern Ireland.

## 2.Your account

You sign in with Google, GitHub or a verified email link. You must give accurate information, keep your sign-in methods secure and tell us promptly if you think your account has been misused. You are responsible for activity under your account, including by teammates you invite. One account per person or business, and you must be at least 18.

## 3.Plans, billing and allowances

Paid plans are billed through Stripe at the price shown at checkout in pounds sterling, plus any taxes shown at checkout. There is a Free plan with the limits shown on the pricing page; it needs no payment card and may change for new sign-ups. Monthly subscriptions renew automatically each month until you cancel in the billing portal; cancelling stops future charges and you keep access until the end of the period you have paid for.

Each plan has a number of websites and a monthly event allowance (pageviews, custom goals and outbound clicks). Allowances reset on the first day of each calendar month in UTC. When you reach your event limit, new events are not recorded until the reset or an upgrade, but existing reports stay available. If a downgrade leaves you with more websites than your plan allows, only the oldest websites within the allowance continue tracking.

Upgrades are charged with the payment provider’s previewed proration. Downgrades take effect at the next renewal. We may change prices for future billing periods with at least 30 days’ notice; the change applies from your next renewal and you may cancel before it.

## 4.Founder Lifetime

Founder Lifetime is a limited one-off purchase for the Growth allowance (10 websites and 250,000 events per month) with no recurring fee. It is limited to 10 successful purchases and checkout may temporarily reserve a place. A refunded purchase still counts towards the original 10. “Lifetime” means for the operating lifetime of the Service. It is not a promise that the Service will operate forever, and it does not include unlimited usage. Refunds and unresolved payment disputes may end access.

## 5.Cancellation and refunds

You can cancel at any time. If the Service is not right for you, you can ask for a full refund within 14 days of your first payment, as set out in our [Refund Policy](https://analytics.5h3ll.site/refund). Nothing in these terms limits any statutory right you have as a consumer.

## 6.Acceptable use

You must use the Service lawfully and only on websites you own or are allowed to manage. You must not:

- track visitors without the notices and consents that the law requires where you operate;
- send us unlawful, infringing or malicious content, or try to disrupt, probe or overload the Service;
- use the Service to send spam, to track people covertly or to harm others;
- circumvent usage limits, resell the Service or share account access in a way that avoids fees;
- put passwords, API keys, payment card details or special category personal data into support tickets.

## 7.Your data and your visitors’ data

You own your data. You give us the right to host and process it only to run the Service for you. For visitor data collected on your websites, **you are the controller and we are your processor**; our [Data Processing Agreement](https://analytics.5h3ll.site/dpa) forms part of these terms. You are responsible for your own privacy notice, for any consent or cookie banner you need, and for your lawful basis for linking visitors to customers or payments. Our optional consent tools help but do not certify compliance.

We handle your own account data as described in our [Privacy Policy](https://analytics.5h3ll.site/privacy). You can delete a website and its data at any time from its settings.

## 8.Third-party services and agents

The Service can connect to services you choose, such as Stripe, Dodo Payments, Google, GitHub and AI agents. Those services have their own terms and we are not responsible for them. When you authorise an agent, it acts with the access you approve, which you can revoke in Account settings. Product names are used only to describe compatibility; no affiliation or endorsement is implied.

## 9.Support

Signed-in customers can open support tickets and we aim to reply promptly, but we do not promise a particular response time. Closed tickets are deleted 12 months after closing, as described in our [Privacy Policy](https://analytics.5h3ll.site/privacy#support).

## 10.Our rights and yours

The Service, its software, design and brand, including the name and the Frosty mascot, belong to 5H3LL or its licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these terms. You must not copy, reverse engineer or build a competing service from it, except as the law allows. Feedback you give us can be used without obligation. Open source components remain under their own licences.

## 11.Availability and changes

We work to keep the Service running and your data safe, but we cannot promise it will always be available or error free. We may update, improve or remove features, and we will try to give notice of changes that significantly reduce what you pay for. Reports depend on information sent by browsers and third parties, so figures, including AI referral sources, may be incomplete.

## 12.Suspension and ending

You can stop using the Service at any time. We may suspend or end access if you break these terms, put the Service or others at risk, or fail to pay, and we will tell you why where we reasonably can. We can also end the Service with reasonable notice, refunding any prepaid period for which you will not receive the Service. Sections that by their nature should continue, such as liability and governing law, survive ending.

## 13.Warranties and liability

The Service is provided with reasonable skill and care but otherwise “as is”. To the extent the law allows, we exclude all other warranties, including that the Service is fit for a particular purpose.

What the law does not let us limit

Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are not affected.

Subject to that, we are not liable for loss of profit, revenue, goodwill or data, or for indirect or consequential loss. Our total liability to you for anything arising under these terms in any 12-month period is limited to the fees you paid us in the 12 months before the event that gave rise to the claim.

## 14.Changes to these terms

We may update these terms. For material changes we will give account holders at least 30 days’ notice by email or in the app before they take effect. If you continue to use the Service after the effective date you accept the new terms. If you do not agree, you can cancel before then.

## 15.Governing law and disputes

These terms and any dispute or claim arising out of or in connection with them or the Service, including non-contractual disputes, are governed by the **law of England and Wales**, and apply equally to customers in **Northern Ireland**, Scotland and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer living in Northern Ireland you may also bring proceedings in the courts of Northern Ireland, and if you live in Scotland, in the courts of Scotland.

Nothing here removes any mandatory consumer protection that applies where you live in the United Kingdom, including under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Please contact us first at [support@5h3ll.site](mailto:support@5h3ll.site); most problems can be sorted out quickly without a dispute.

## 16.General

1. These terms, with our Privacy Policy, Data Processing Agreement and Refund Policy, are the whole agreement between us about the Service.
2. If a part of these terms is unenforceable, the rest still applies.
3. If we do not enforce a right straight away, we do not give it up.
4. You may not transfer your rights under these terms without our consent. We may transfer ours to a successor to the business.
5. Nobody who is not a party to these terms has any right to enforce them under the Contracts (Rights of Third Parties) Act 1999.
